If you hate Tarion – read this……..


One of my links on the side blogroll is for “Canadians for Properly Built Homes”.  A group formed to advocate on behalf of homeowners against  what I will call “Cowboy Builders”.  You know – those builders who promise you the world and move you into “Hells Kitchen, Bathroom, Living Room, etc”.

I just got an email from them asking me to support a petition in support of an Ontario Bill – Bill 98, a private bill put forward by MPP Andrea Horwath.  The short story is that this bill will amend the“Ontario New Home Warranties Plan Act” to give oversight of Tarion and the power to deal with unresolved complaints t the Ombudsman of Ontario.  

In other words, if you have a complaint that Tarion hasn’t been looking after YOU, the homeowner, you can lodge a complaint with the Ombudsman regarding Tarion and the builder.

If you feel that this is important to support go to this link, print out the petition, give it to friends and relatives and any one abused by a builder or Tarion and send it to:  MPP Andrea Horwath, Rm. 114, Main Building, Queen’s Park, Toronto, ON  M7A 1A5  (416) 325-2777.  And remember, the postage is FREE……..

Here is the basis for this petition and it reflects complaints from YOU, the homeowner.

WHEREAS homeowners have purchased a newly built home in good faith and often soon find  they are victims of construction defects, often including Ontario Building Code violations, such as faulty heating, ventilation and air conditioning (HVAC) systems, leaking roofs, cracked foundations, etc. ,

 WHEREAS often when homeowners seek restitution and repairs from the builder and  the Tarion Warranty Corporation, they encounter an unwieldy and bureaucratic system that often fails to compensate them for the high cost of repairing these construction defects, while the builder often escapes with impunity,

 WHEREAS  the Tarion Warranty Corporation is supposed to be an important part of consumer protection system in Ontario related to newly built homes,

 WHEREAS the government to date has ignored calls to make its Tarion agency truly accountable to consumers,

 BE IT RESOLVED that we the undersigned support MPP Cheri DiNovo’s private members bill which calls for the Ombudsman to be given oversight of Tarion and the power to deal with unresolved complaints

Lets see some support for MPP Andrea Horwath and hopefully we will get some support against builders like Mattamy, who have seen fit to just forget about us, the homeowner and our desire to have a quality home.  Unless you like to pay big bucks for sub-standard homes.

  2. Any time you have large sums of money changing hands, in this case the builder “R” and HRM, there is bound to be some level of corruption and a lot of shady business practices. Homeowners are NOT responsible for the price tag on city water. They have already paid for what is supposed to be a sustainable water source. The sole responsibility rests on the builder and HRM.

  3. I fully agree with you, Tarion Warranty Corporation is not accountable for their behavior which is unethical and at times illegal. It is about time for the public to stand up and be heard about Tarion Warranty Corporation in my opinion is out has no credibility. They provide a feel good warranty to most home buyers but when they must be accountable you are ignored. When you take them to court they attach you what type of consumer protection is this- shut your mouth or we will break you. According to one of their former counsels: Tarion overwhelmes anyone who challenges them using any means to do so. Their actions are not investigated by Government Services,or by the Ministry of Municipal Affairs who have washed their hands of the matter because Tarion is not part of the government; yet they enforce the Ontario New Home Warranty Program with no accountability.
    What about the consumers they are supposedly protecting? You can not wear two hats at the same time – it did not work for Al the hockey czar – so why should it work for Tarion Warranty Corporation.
    Yet, even thou the Attorney General of Ontario was informed a few years ago about suspicious deals surround Tarion Warranty Tribune hearing – where transcripts went missing, in at least three different cases. This is not just human error as Tarion would like you to think. In other cases Tarion Warranty Corporation employee lied under oath in court with little consequences. I thought to purger ones self in court was a criminal offense. In more alarming evidence because this information I am speaking about is in transcript form unless they have gone missing too, but Chris Bentley’s office I hope will make sure it does not disappear as I had requested them to do all most 2 years ago.
    The question how can these wrong doings be allowed: Well Mr. Marshall Gavin a Tarion Warranty Corporation employee answered in court ” we are except” oh great now we have people above the law, enforcing the law, protecting us. Well I do not feel very protected nor do I take comfort in know thugs like Marshall Gavin who are except from the law are protecting us. This individual did not act alone it is the entire corporate culture of Tarion that smells like Denmark. No one individual could operate like this without superiors know and condoning his actions. (Marshall Gavin was with Tarion for several years)
    Knowing such a ruthless, unethical organization like Tarion Warranty Corporation makes me sad to say I live in Ontario.

    The Amish have a saying: ” When right becomes wrong and wrong becomes right the end is near”. I support Bill 98 and promote it everywhere I go.

    FOR TARION THE END IS NEARING the period of corruption and greed will soon end I can only hope.

    • I agree with you. I have had very negative experiences with Tarion. I truly believe they are biased toward the builders’ point of view and interests. I have have voiced my opinion directly to them over the past 2 years. It seems to me, after more than 2 years experience with them, that they are not really accountable to anyone “above” them at all.
      We are forced by law to pay our warranty money to Tarion, and they hold a monopoly on new home warranties in this province. Our money goes to them by law no matter whether they actually “protect new home buyers” or not. They seem to be contented with the status quo. So are short-cutting builders.

  4. Both comments were very relevant and show how bad the problem really is in terms of warranty and builders. HOmeowners need better protection and they don’t seem to get it from their elected officials and planning staff, who are paid to ensure a community is built properly. In my case, it was quite obvious that the Town of Oakville was allowing Mattamy greater freedom than should have been allowed. Thanks for the comments.
